Welcome to Polymath Park Resort. We provide hospitality and experience-based services, including chef-curated dining (in-house, patio, and private treehouse-style dining), overnight lodging through our Frank Lloyd Wright accommodations, guided tours of Polymath Park, and gift certificates.

These Terms and Conditions ("Terms") govern your use of our website, services, and materials ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of our Service.

1. Your Account

Eligibility: You must be at least 18 years old to make reservations or bookings or to create an account. Guests under 18 are welcome to visit and dine when accompanied by a responsible adult.

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.

Accuracy: All information you provide to us must be accurate, complete, and current. False or misleading information may result in cancellation of a reservation or booking, or suspension or termination of your account.

2. Your Use of the Service

Permitted Use: You may use our Service only for lawful purposes and in compliance with these Terms.

Prohibited Conduct: You agree not to:

Use the Service in violation of any local, state, or federal law or regulation.

Transmit any false, harmful, or misleading information.

Make fraudulent, speculative, or duplicate reservations or bookings.

Attempt to gain unauthorized access to any part of our systems or guest data.

Interfere with or disrupt the operation of the Service or related networks.

Reproduce, distribute, or commercially exploit any materials without prior written consent from TreeTops Restaurant & Polymath Park.

Guest Information: You retain ownership of any personal information you provide. We use this information solely for providing and improving our services, in accordance with our Privacy Policy.

3. Intellectual Property

Our Content: All materials, trademarks, service marks, logos, designs, menus, and content on our website or in our communications (excluding your data) are the property of TreeTops Restaurant & Polymath Park or its licensors and are protected by intellectual property laws.

No Unauthorized Use: You may not copy, modify, distribute, display, sell, or lease any part of our content, menus, or materials without our prior written permission.

4. Payments, Deposits, Cancellations, and Gift Certificates

Pricing: Pricing for dining experiences, lodging, tours, and other services is displayed on our website or agreed upon in writing. We reserve the right to modify pricing with reasonable notice.

Payment Terms: Payments, deposits, or prepayments are due per the terms of your selected reservation, booking, or experience. You authorize us or our payment processors to charge your selected payment method for agreed services.

Reservations and Deposits: Certain dining experiences, lodging stays, and tours may require a reservation, deposit, or prepayment to secure your booking. Deposits may be non-refundable as stated at the time of booking.

Cancellations and No-Shows: Cancellation and no-show policies are provided at the time of booking. Late cancellations or failure to appear may result in forfeiture of deposits or charges to your payment method.

Refund Policy: Refunds are granted only as explicitly stated in writing at the time of booking or as required by law.

Gift Certificates: Gift certificates are subject to any terms, restrictions, and expiration policies stated at the time of purchase, and are non-refundable except where required by law.

5. Food Allergies, Health, and Special Requests

Allergen Notice: While we make reasonable efforts to accommodate dietary restrictions and food allergies when notified in advance, our kitchen handles common allergens and we cannot guarantee that any item is free from allergens or cross-contact. Guests with severe allergies dine at their own discretion and should inform our staff of any allergies or dietary needs before ordering.

Special Requests: We will make reasonable efforts to honor special requests (such as seating preferences, accessibility needs, or celebration arrangements) but cannot guarantee their fulfillment.

6. Property, Tours, and Assumption of Risk

Conduct on Premises: While on our premises, you agree to follow all posted rules, signage, and instructions from our staff. We reserve the right to refuse service or remove any guest whose conduct is unsafe, unlawful, or disruptive to other guests.

Outdoor and Treehouse Experiences: Our property includes outdoor areas, walking paths, elevated treehouse-style dining structures, and tour routes. You participate in these experiences voluntarily and assume the ordinary risks associated with outdoor activities and uneven terrain. You are responsible for supervising any minors in your party at all times.

7. Termination

We reserve the right to suspend or terminate your access to our Service, or to cancel a reservation or booking, at any time, with or without notice, for violation of these Terms or for any conduct we determine to be harmful or unlawful. Upon termination, your right to use the Service ceases immediately.

8. Disclaimers and Limitation of Liability

"As Is" Basis: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, error-free, or secure operation.

Limitation of Liability:

To the fullest extent permitted by law, TreeTops Restaurant & Polymath Park, its owners, affiliates, employees, and partners are not liable for any indirect, incidental, consequential, or special damages (including loss of income, data, or opportunity) arising from:

Your use or inability to use the Service;

Third-party content or actions;

Unauthorized access to your data; or

Reliance on any information provided by us.

Your sole remedy for dissatisfaction with the Service is to stop using it.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

10. SMS/Text Messages

10.1 SMS Program Description

Our SMS program provides text messages for reservation and booking reminders, events, receipts, customer service, and occasionally promotional messages when you opt in. Message frequency varies depending on your interaction with our services.

10.2 Opting Out

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode (number provided). Upon sending "STOP", we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, or text "START" to resume receiving messages.

10.3 Help and Support

If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance or email "[email protected]".

10.4 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

10.5 Messaging and Data Rates

Message and data rates may apply for messages sent to you from us and from you to us. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

10.6 Recurring Messages Disclosure

By opting into our SMS program, you authorize us to send recurring text messages to the mobile phone number you provide. Depending on your service selection, you may receive regular recurring messages. You are not required to agree to receive recurring messages as a condition of purchasing any goods or services.

10.7 Prohibited Content

Our SMS messages will never contain:

- Phishing attempts, smishing, or social engineering to manipulate you into sharing private information.

- Illegal content (all content complies with federal and state laws).

- SHAFT content (sex, hate, alcohol, firearms, and tobacco) that does not follow federal and state laws and regulations.

10.8 SMS Opt-In Data Protection

All text messaging originator opt-in data and consent information will not be shared with any third parties, excluding aggregators and providers of the Text Message service necessary to deliver the SMS service. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

11. Additional Protections and Liability Waivers

11.1 Data Security Standards

The Company implements reasonable security measures to protect your personal information in accordance with industry standards. However, no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we can provide no guarantee concerning the security of said data.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. Any material updates will be posted on our website, and the "Effective Date" above will reflect the most recent revision. Continued use of our Service after updates constitutes acceptance of the new Terms.
